Ban supporters question state preemption

Supporters of a ban on biotech crops in Oregon’s Josephine County may seek to overturn a state law that blocks local regulations of such crops.

A ban on genetically engineered crops passed May 20 in Oregon’s Josephine County may set the stage for litigation over a state law that preempts such local regulation.Voters approved a ballot initiative that prohibits growing genetically modified organisms in the county, but a statute passed by the Oregon legislature last year precludes such action by local governments.
